Terms of Service & Emergency Transport Agreement

1. Constitutional Mandate & Right to Life (Article 21)

Emergency medical transportation is an integral component of the Right to Life guaranteed under Article 21 of the Constitution of India, as affirmed by the Supreme Court of India in Pt. Parmanand Katara v. Union of India (1989). Rapid Ambulance operates as a technology aggregator connecting citizens in critical need with certified emergency medical response vehicles. No patient in life-threatening emergency conditions shall be denied emergency dispatch assistance due to procedural delays.

2. Protection of Good Samaritans (Section 134A, Motor Vehicles Act 1988)

In accordance with Section 134A of the Motor Vehicles Act, 1988 (as amended by the Motor Vehicles Amendment Act, 2019) and the Good Samaritan Guidelines issued by the Ministry of Road Transport and Highways (MoRTH): (a) Any person who books or requests an emergency ambulance for an injured, sick, or unconscious victim shall be treated as a Good Samaritan. (b) Good Samaritans are protected from any civil or criminal liability and shall not be compelled to disclose personal identity, contact details, or pay hospital admission expenses. (c) Police officials, hospital administration, or emergency personnel shall not harass or detain any caller or bystander requesting assistance via the Rapid Ambulance platform.

3. Platform Scope & Emergency Triage

Rapid Ambulance provides digital matchmaking services connecting users with independently owned and operated ambulance providers (Basic Life Support - Type B, Advanced Life Support - Type C, Patient Transport - Type A, and MICU - Type D) compliant with AIS-125 standards. Fares are calculated dynamically based on distance, traffic conditions, vehicle tier, and vital life support equipment requirement.

4. Cancellation & Emergency Priority Policy

To ensure rapid availability during life-threatening crises, booking cancellations after ambulance dispatch are subject to a nominal cancellation fee. However, if an ambulance fails to arrive within reasonable safety parameters due to extreme traffic or force majeure, cancellation charges shall be waived in full. Fraudulent or false emergency requests constitute an offense under Indian Penal Code (IPC) / Bharatiya Nyaya Sanhita (BNS) and will be reported to law enforcement.

5. Limitation of Liability & Medical Disclaimer

Rapid Ambulance is a technology platform and does not directly employ emergency medical technicians (EMTs) or doctors unless specified. Paramedical care provided en-route is the direct professional responsibility of the certified emergency personnel onboard the assigned ambulance.
